Terms and Conditions for Divers English Online Learning Services and Lessons

 

1. Introduction

Welcome to DIVERS ENGLISH. By accessing our website and using our English learning services, you ("user", "subscriber") agree to be bound by these Terms and Conditions. These terms apply to all users of the site, including without limitation, users who are browsers, subscribers, participants in private or group lessons, and/or contributors of content.

2. Subscription Fees and Access (For Online Videos ONLY)

Our services are accessible via a monthly subscription fee. Details of the subscription options, fees, and payment methods are available on our website. Upon subscribing, users gain immediate access to all available content, including instructional videos and other learning materials.

Fees:
¥1,200/month (tax included)

3. Private and Group Lessons

3.1 Private Lessons:

Private lessons are available for both General English and SCUBA Divers English learners. Lessons will be conducted in-person, and are designed to help individual learners improve their communication skills in their chosen focus area.

  • Fees: General English and SCUBA Divers English private lessons are ¥32,000 per month, with an additional fee of ¥8,000 per month if lessons are conducted at the student’s home.

  • Payment: Payments must be made in cash at the first lesson of each month. If the payment is not made at the start of the lesson, the student will need to retrieve cash, potentially missing part of the lesson.

  • 4 lessons per month (48 lessons annually)

  • Each lesson lasts 60 minutes

Lesson Locations:

  • Lessons can be held at a cafe or restaurant near a station, a free space with tables and chairs, the student’s dive shop, or their home.
    If lessons are held at the student’s dive shop, the space must include tables and chairs suitable for learning. The student must confirm the availability of the space and secure it for each lesson.
    For locations over 10 minutes' walk from the nearest station or requiring bus or taxi use, an additional fee of ¥8,000/month (tax included) applies. Some locations may not be serviceable based on the region.

 

3.2 Group Lessons:

Group lessons are available for both General English and SCUBA Divers English learners, designed for two or more participants. Each group must be self-organized (participants must bring their own group members), and the focus is on communication skills within the chosen subject area. General English lessons have a maximum of two learners whilst SCUBA Divers English Lessons have a minimum of two learners.

  • Fees: General English and SCUBA Divers English group lessons are ¥22,000 per person per month, with an additional fee of ¥8,000 per month if lessons are conducted at a student's dive shop, home, or any other agreed location.

  • Payment: Payments must be made in cash at the first lesson of each month. If one student fails to pay, that student will miss part of the lesson to retrieve payment while the other participant continues.

  • 4 lessons per month (48 lessons annually)

  • Each lesson lasts 60 minutes

3.3 Enrollment Fee:

  • All new students are required to pay a one-time entrance fee of ¥8,000 upon entering the school. This fee is non-refundable and is only paid when a student first joins the school.

  • If a student leaves the school and later returns, they will be required to pay the ¥8,000 entrance fee again, unless their leave of absence was approved by the school in advance.

 

4. Automatic Subscription Renewal (For Online Videos)

Subscriptions for online videos are billed on a recurring basis. The automatic subscription payment will be charged to your provided payment method each month on the date of your initial subscription.

 

5. Cancellation Policy

 

5.1 Online Videos:
Users may cancel their subscription at any time. To avoid being charged for the next month, cancellation must be done before the monthly billing date. Upon cancellation, access to the service will continue until the end of the current billing cycle.

 

5.2 Private Lessons:
Cancellations must be made a day in advance to qualify for a makeup lesson. Only one makeup lesson is allowed per month, and same-day cancellations will be considered absences with no refund or makeup. To cancel, notify the instructor by 11:59 PM the day before the lesson via LINE, email, text message, or phone. For notifications after 7:00 PM, use LINE or email. Messages received after 7:00 PM will be acknowledged the next morning or later. To schedule a makeup lesson, contact the instructor directly or use LINE, email, text message, or phone.

Leave of Absence for Private Students:

  • If a private student wishes to take a leave of absence for the following month but would like to reserve their time slot for their return, they may do so by paying half of their usual lesson fee for the month of absence. This payment must be made on the last lesson before the student begins their leave.

  • During the student’s absence, their reserved day and time slot will remain unavailable to other students. However, if the student does not opt for this service, their time slot will be vacated, and if filled by another student, they will need to choose a different day and time upon their return.

  • The maximum leave of absence period is two months. After this period, the student must either return and pay the full lesson fee or choose to leave the school. If they do not return, they will be charged the full price for each additional month they remain absent.

 

5.3 Group Lessons:

  • No cancellations are allowed for group lessons. Absences will be charged, and no makeup lessons will be provided.

  • If the teacher cancels, each student will be refunded ¥4,500 for that missed lesson.

 

Leave of Absence Group Students:
Group students cannot reserve their time slots during a leave of absence. Any group student who takes a month off will be regarded as absent and must still pay for the missed month.

 

6. Refund Policy

 

6.1 Online Videos:
Refunds are not available once payment has been made.

 

6.2 Private Lessons:
No refunds are available for mid-month cancellations. However, if the teacher cancels a lesson, the student will be refunded ¥7,000 per missed lesson, paid in cash at the next lesson. If both parties agree, the student may take a makeup lesson instead of receiving a refund. Makeup lessons must be scheduled within one month of the canceled lesson; otherwise, they will be forfeited.

 

6.3 Group Lessons:
In case of teacher cancellations, group students will be refunded ¥4,500 per missed lesson. If one group participant leaves, the remaining participant may either switch to private lessons or find a new participant for the group.

 

7. Lateness and Communication

 

7.1 Student Lateness:

  • If a student is late for class and does not respond to the teacher's messages or phone calls, the teacher will wait for 20 minutes at the agreed meeting point. If there is no communication from the student during this period, the teacher will leave, and the class will be considered an absence. The student will be charged for the missed lesson, as per the absence policy.

 

7.2 Teacher Lateness Due to Train Delay:

  • If the teacher is late by more than 10 minutes due to a train delay or any other reason, the class will be canceled, and the student will be refunded for the missed lesson.

  • Alternatively, if both the teacher and student agree, a makeup class may be scheduled instead of a refund. This arrangement must be discussed with the teacher directly.

  • If the teacher is late by less than 10 minutes, the additional time will be added to the end of the current lesson. If this is not possible due to the student's availability, the time will be added to a future lesson by mutual agreement, either before or after the class. The teacher will strive to avoid lateness and will communicate promptly in case of any anticipated delays.

 

7.3 Communication with the Teacher via LINE App:

  • Students are required to add the Divers English LINE account to their LINE contacts. A QR code for the LINE account will be provided in the contract, allowing for direct communication with the teacher.

  • Students can use this channel to inform the teacher of lateness, absences, or cancellations, or to make general inquiries. The teacher’s phone number will also be provided for calls if needed.

7.4 Headphones/Earphones Requirement

  • Not required for lessons held at rental offices or at the student’s home.

  • For listening activities in both Private and Group lessons, students are required to bring their own headphones or earphones. The teacher will provide the listening materials, but to ensure a quiet and focused environment, students must use their personal headphones or earphones during these activities.

  • If a student forgets their headphones or earphones, the lesson will continue without the listening sections, and will be given as homework.

 

8. Use of Service

As a subscriber or participant, you have access to English instructional videos and lesson content. These resources are for personal, non-commercial use only. Unauthorized distribution, modification, or commercial exploitation of any content is strictly prohibited.

 

9. User Conduct

Users are expected to use our services responsibly. Any form of abuse, harassment, or illegal activity is strictly prohibited and may result in immediate termination of your account or lessons.

 

10. Termination and Account Cancellation

  • We reserve the right to terminate or suspend access to our service or lessons for any user who violates these Terms. Users may cancel their subscription to online videos at any time via their account settings or by contacting us directly.

  • Lessons may be terminated by providing one month's notice. If a student leaves and later returns, they will be required to pay the ¥8,000 entrance fee again unless their leave of absence has been approved by the school.

 

11. Limitation of Liability

DIVERS ENGLISH will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services or lessons.

 

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

 

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.

19. Cancellation and Refunds Policy:

  • Subscriptions for online videos can be canceled at any time. Refunds are not available once paid.

  • No refunds are available for mid-month cancellations for lessons unless the teacher cancels the class.

 

20. Delivery Times:

  • Access to video content is immediate upon subscription confirmation.

 

21. Accepted Payment Methods:

  • Credit Card, Debit Card, and PayPal (for online videos).

  • Cash payment for lessons.

 

22. Payment Period:

  • Subscription fees are charged monthly on the date of sign-up.

  • Lesson fees are payable at the first class of each month.

 

23. Exchanges and Returns:

  • As we provide a digital service and lessons, exchanges and returns are not applicable.

  • Books that are purchased through the school will be checked by the students and confirmed that the book is in ‘new’ condition. Thereafter, returns will not be applicable.

 

24. Operating Environment for Service:
Compatible with modern web browsers on desktop and mobile devices (Divers English Online Only).

  • Monday through Friday, 12:00 PM to 7:00 PM (excluding school holidays).

  • After 7:00 PM, please contact us via LINE or email.

  • Messages received after 7:00 PM will be responded to the next business day or later, with inquiries addressed within two business days.

School Holidays:

  • Closed on Saturdays, Sundays, and during school holidays as indicated on the DIVERS ENGLISH SCHOOL calendar.

  • On Saturdays and Sundays, only absence or cancellation notifications will be accepted via LINE or email.
